First Pass Terms & Conditions

These terms govern how FIRST PASS PTY LTD, trading as FIRST PASS, provides the FirstPass website and booking platform for learners and instructors in Australia, including New South Wales.

1. Overview

By using the FirstPass website, creating an account, browsing instructor profiles, making a booking, paying for a service, or otherwise using the platform, you agree to these Terms and Conditions.

FIRST PASS PTY LTD operates FIRST PASS as an online platform that connects learners with driving instructors. The platform includes learner and instructor accounts, instructor public profiles, search and filters, reviews and ratings, booking tools, availability and calendar features, driving lesson bookings, driving test package bookings, Stripe payment processing, learner purchase records, instructor earnings records, admin finance reporting, notifications, and related dashboard features.

2. Accounts and Platform Use

  • You must provide accurate, current, and complete information when creating or using a learner or instructor account.
  • You are responsible for keeping your login details secure and for all activity carried out through your account.
  • You must not misuse the platform, impersonate another person, provide false information, interfere with bookings, or use the website for unlawful or misleading purposes.
  • We may suspend, restrict, or close an account where we reasonably believe there is misuse, fraud, a security issue, inaccurate information, or a breach of these terms.
  • An instructor application submitted through the website may create an instructor account or application record in a pending review or inactive status. Submission does not guarantee approval, public profile visibility, booking eligibility, or access to all instructor features.

3. Bookings and Services

The FirstPass platform allows learners to search for instructors, view public instructor profiles, choose lesson type and transmission type, check availability, and book driving lessons or driving test package services through the booking flow.

  • Bookings are subject to instructor availability and successful completion of the booking process shown on the website.
  • Learners must check the lesson type, transmission type, pickup details, booking date, time, and any driving test package details before completing payment.
  • If an instructor profile or booking flow states that the instructor is accredited to teach manual driving but does not provide a manual vehicle, the learner must supply a suitable manual vehicle for those lessons.
  • Driving test package services arranged through FIRST PASS do not replace any requirement imposed by Service NSW, TfNSW, or any other road or licensing authority.
  • The FirstPass driving test package covers the package services shown on the website, such as pickup, warm-up lesson, use of instructor car, and drop-off where displayed. Unless the website expressly states otherwise, the learner is responsible for arranging and holding any official road-test appointment required by the relevant road or licensing authority.
  • FirstPass currently allows only one active driving test package booking at a time. A learner may need to complete, cancel, or otherwise resolve an existing active test package before booking another one.
  • The change-instructor or switch-instructor flow, where available, is intended for future bookings. Existing bookings remain with the original instructor unless separately cancelled, rescheduled, or changed through a supported platform process.
  • Instructor availability, profile content, vehicle information, and service regions are displayed from platform records and information provided by instructors, and may change if availability or compliance details are updated.

4. Payments, Settlements and Dashboard Records

Prices are shown in Australian dollars unless stated otherwise. Learner checkout is processed through Stripe or payment methods made available by Stripe on the FirstPass website. Any available payment options will be shown during checkout on the live website.

  • Learners generally pay upfront for bookings made through the platform.
  • Payment records, booking records, Stripe payment intent references, learner purchase visibility, instructor earnings visibility, and related dashboard, wallet, ledger, payout, or settlement records are generated according to the live FirstPass platform workflow.
  • Platform payment, settlement, wallet, and payout statuses are internal accounting records used to administer the service. Unless expressly stated otherwise, they do not mean that funds are held in a separate trust account.
  • Instructor earnings generally remain pending until the relevant lesson or service is completed and processed through the platform workflow.
  • After a lesson or eligible service is completed, the platform may split or record the payment between instructor earnings and the FirstPass admin commission according to the active commission and settlement settings.
  • Instructor payout eligibility may depend on completed lessons, account status, Stripe Connect or connected payment account setup and status, compliance status, fraud checks, refund risk, chargebacks, disputes, and any applicable platform review.
  • Admin commission, instructor earnings, wallet balances, financial ledger entries, finance reports, and reconciliation screens are platform records intended to help administer payments, refunds, payouts, and reporting.
  • Payment does not automatically entitle a learner to a refund for change of mind, unless required by law.
  • Where a booking has already been paid for, the learner is not automatically entitled to a cash refund because they want to cancel, reschedule, or not attend the booking.
  • Any refund, rebooking, credit, waiver, payout adjustment, or other remedy offered through the platform is subject to the live FirstPass booking flow, payment provider rules, dispute or chargeback outcomes, and any rights that cannot be excluded under Australian Consumer Law.
  • Nothing in these terms excludes or limits any consumer guarantee or statutory right that applies under Australian law.
Important: Where Australian Consumer Law applies, statutory rights and remedies continue to apply even if the website also contains booking, refund, waiver, or credit rules.

5. Cancellations, Rescheduling and No-Show Rules

FIRST PASS uses booking-status and payment-status logic across the booking flow, dashboard history, instructor views, and finance records. These statuses may include pending payment, paid, confirmed, completed, cancelled, rescheduled, waived, refunded, no-show, settlement pending, settled, or similar labels.

  • Learners may cancel or reschedule a booking only if the request is made more than 12 hours before the scheduled start time.
  • If a learner attempts to cancel or reschedule within 12 hours of the booking start time, the platform currently blocks that request.
  • Where a scheduled booking is not completed, the instructor-side workflow may currently result in one of the supported platform outcomes, including payment waived or no-show charged.
  • If a learner does not attend a booking and the platform applies a no-show charge, the learner may be charged up to the full booking amount, subject to any rights that apply under Australian law.
  • Where payment is waived through the platform, the learner is not charged for that missed booking outcome.
  • Completed bookings, cancelled bookings, payment-waived bookings, refunded bookings, and no-show-charged bookings may appear in learner, instructor, admin, finance, and dashboard records using those or similar status labels.
  • If an instructor cancels and a replacement or rebooking is not available through the platform flow, the learner may be offered the remedy shown on the site at that time, which may include rebooking, credit, or refund.
  • If a service is not supplied with due care and skill, is not fit for purpose, or otherwise does not meet legal requirements, Australian Consumer Law rights may still apply.

6. Instructor Information and Compliance

  • Instructors are responsible for keeping their profile, vehicle details, service regions, availability, document records, and accreditation information accurate and up to date.
  • Instructors may be required to complete application review, accept applicable platform terms, provide required compliance documents, and maintain an approved profile or vehicle record before appearing publicly or accepting bookings through the platform.
  • Instructor vehicles, driving licence records, instructor licence records, WWCC records, and related compliance information may be reviewed, approved, rejected, or requested to be updated through the platform.
  • Vehicle lookup or compliance support tools may help pre-fill or verify vehicle details, but instructors remain responsible for checking that all vehicle, insurance, registration, licence, and accreditation details are accurate and current.
  • If a required document or vehicle record expires, is rejected, is missing, or becomes invalid, FIRST PASS may restrict the related profile, service offering, or booking visibility until updated information is approved.
  • Instructors must keep their availability calendar reasonably current and must not knowingly accept bookings they cannot service safely and lawfully.
  • FIRST PASS may remove, reject, or request correction of information that appears inaccurate, incomplete, expired, misleading, or non-compliant.

7. Protecting FirstPass Bookings

FirstPass invests in marketing, technology, support, payment processing, booking tools, instructor profiles, learner dashboards, and platform safety features to connect learners and instructors.

  • Learners and instructors must not deliberately use FirstPass to find each other and then move the same booking or related driving service off-platform in order to avoid platform fees, records, protections, or booking rules.
  • Instructors must not ask, pressure, encourage, or accept a FirstPass learner to book or pay outside FirstPass for lessons, test packages, or related driving services first introduced through FirstPass.
  • Instructors must not share private payment instructions, booking links, discount offers, or contact details for the purpose of moving FirstPass bookings away from the platform.
  • Learners must not use FirstPass to find an instructor and then deliberately arrange the same booking outside FirstPass to avoid platform fees, payment records, or booking rules.
  • This restriction applies for 12 months after the later of the first platform contact, the last booking, the last payment, or the last completed lesson involving that learner and instructor through FirstPass.
  • This restriction does not prevent genuine emergency contact, lesson-day coordination for a confirmed FirstPass booking, lawful communications, or relationships that clearly existed independently before FirstPass introduced the learner and instructor.
  • Bookings made outside FirstPass are not covered by FirstPass payment records, learner purchase visibility, dashboard history, support, refund handling, settlement logic, dispute assistance, or platform protections.
  • If we reasonably believe an instructor is diverting learners or bookings away from FirstPass, we may investigate, issue a warning, restrict features, pause search visibility, review payouts, suspend or terminate the account, or seek recovery of platform fees or losses where legally available.
Fair use: This clause is intended to stop deliberate platform bypassing, not to stop ordinary learner-instructor communication needed to deliver a confirmed FirstPass booking safely and professionally.

8. Reviews, Ratings and User Content

  • You must not upload, submit, or publish unlawful, defamatory, misleading, infringing, false, or offensive material through the platform.
  • Reviews and ratings must be genuine and based on real experience with the relevant lesson or instructor.
  • Instructor profile text, vehicle information, documents, learner details, and other user-supplied material must not be false or misleading.
  • We may moderate, remove, or restrict material where reasonably necessary for platform safety, accuracy, or legal compliance.

9. Liability and Australian Consumer Law

To the maximum extent permitted by law, FIRST PASS PTY LTD excludes liability for indirect, incidental, special, or consequential loss arising from use of the website, booking platform, or related services.

However, nothing in these terms excludes, restricts, or modifies rights that cannot lawfully be excluded, including rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

10. Changes to These Terms

We may update these terms from time to time, including when the booking flow, Stripe checkout, refund handling, instructor payout process, compliance tools, dashboard features, or admin finance reporting changes. The version published on the FirstPass website applies from its stated effective date. Continued use of the platform after an update means you accept the revised terms.
